The European Commission has proposed a new Pact on Migration and Asylum for the European Union in the hope that it will solve the deep-seated political crisis that … There is a broad use of measures such as detention and expulsion, and they often try to avoid the responsibility of processing asylum requests, as the clashes following disembarkation after search-and-rescue operations in the Mediterranean show. Indeed, on the 27th of February 2020, Turkish President Recep Tayyip Erdoğan started to let migrants enter the EU, breaking the EU-Turkey agreement. The European Commission’s (EC) New Pact on Asylum and Migration has been launched under the fifth priority of the EC’s ‘Promoting our European Way of Life’ programme and is a response to the flaws in the system that have been visible during the so-called “migration crisis”. Pragmatism has prevailed over principle in the new pact, marking a shift in perception of migration which signals the adoption of a “‘new normality.” The EU risks paying too much attention to a security-driven policy, relegating to the background the underlying causes of migration, such as underdevelopment, unemployment, poverty, and instability. Finally, until the screening procedure is completed, the person will not be considered as having legally entered the state’s territory, leading to a stronger linkage between asylum and expulsion. Moreover, to encourage cooperation by third countries, the new pact foresees a link between cooperation on readmission and visa issuance in the Visa Code. Yet, they are highly restrictive and selective by definition, and do not represent a viable solution for a broader population. A Pact for Europe starts in Europe The Pact is an opportunity to improve asylum systems in Europe, to greatly expand safe and legal channels, and to mobilise EU support for inclusion. It sets out improved and faster procedures throughout the asylum and migration system. In case a member state committed to return sponsorship fails to execute the return in eight months, it will have to relocate the individuals within its territory. In these cases, other member states would have to commit to the mandatory relocation of applicants under international protection or to return sponsorship. The rationale for the New Pact on Migration and Asylum seems to follow that for the MPF:  external migratory pressure is becoming the new normality and a more coordinated and restrictive policy focused on mobility is necessary.
